5. PROPER USE & SUPERVISION

You agree to use the product only as instructed and for its intended purpose.

Misuse, abuse, unauthorized modification, improper installation, or unauthorized repair strictly voids all warranties and protections.

You further agree to prevent unauthorized, improper, or unsupervised use, including use by children or third parties.

 

6. SAFETY DISCLAIMER

TheraVibe vibration platforms are designed for general fitness and wellness purposes only.

They are not intended to diagnose, treat, cure, or prevent any medical condition.

By purchasing and/or using this product, the customer acknowledges full responsibility for its safe and proper use.

Failure to follow product instructions may result in injury.

 

7. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law:

TheraVibe, its owners, officers, employees, affiliates, representatives, suppliers, and distributors shall not be liable for any injuries, damages, losses, or claims arising from the use or misuse of any product.

This includes, but is not limited to:

  • Direct damages

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Special damages

Liability is strictly limited to the original purchase price of the product.

 

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless TheraVibe, its owners, officers, employees, affiliates, representatives, and distributors from and against any and all claims, liabilities, damages, costs, or expenses (including legal fees) arising from:

  • Your use or misuse of the product

  • Any third-party use after purchase

  • Violation of these terms

 

9. WARRANTY POLICY

TheraVibe® provides a lifetime warranty covering manufacturing defects under normal use.

This warranty does not cover:

  • Misuse or abuse

  • Unauthorized modifications or repairs

  • Cosmetic damage

  • Normal wear and tear

Proof of purchase is required for all warranty claims.

TheraVibe reserves the right, at its sole discretion, to:

  • Repair

  • Replace

  • Refund

Liability under warranty is limited to the purchase price of the product.

10. SALES POLICY

All sales are final unless otherwise required by applicable law or expressly stated in writing by TheraVibe.

 

11. SHIPPING DISCLAIMER

Delivery dates are estimates only and are not guaranteed.

TheraVibe shall not be held liable for delays caused by carriers, logistics providers, or circumstances beyond our control.

16. DISPUTE RESOLUTION

All disputes arising from or relating to the use of TheraVibe products shall be resolved exclusively through binding arbitration.

  • Arbitration shall take place in the State of Florida

  • Class actions are expressly waived

  • Each party shall bear its own legal costs unless otherwise determined

 

17. GOVERNING LAW

These Terms and all policies herein shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.

 

18. ENTIRE AGREEMENT

These policies constitute the entire agreement between the customer and TheraVibe.

They supersede all prior agreements, communications, or understandings, whether written or oral.

 

19. MODIFICATIONS

TheraVibe reserves the right to update, modify, or change these policies at any time without prior notice.

Continued use of the product constitutes acceptance of any such changes.
